Terms of business

How an order comes about, how payment works, what I need from you and who owns the copyright.

Last updated: Applies to zanmeke.com

This is a translation. In case of doubt, the Slovenian version prevails.

These terms apply to website design and build, photography, AI assistants and related services that a client orders from the provider.

Provider and controller of personal data: Računalniško programiranje, Žan Meke s.p. (registration in progress), Glavni trg 41a, 8290 Sevnica, Slovenia, tax number 27636623, entry in the Slovenian Business Register (PRS) in progress (expected 1 November 2026) · info@zanmeke.com · +386 41 401 521

How an order comes about

After we talk, I prepare a quote with a description of the work, the price and the deadline. The quote is valid for 30 days. The contract is concluded when you confirm the quote and pay the first instalment — written confirmation by email is sufficient.

A quote is not a tax document. You receive an invoice once payment has been received.

Prices and payment

  • Prices are final. VAT is not charged (Art. 94(1) ZDDV-1). I prepare an exact offer after we talk; the price in the confirmed quote applies.
  • The setup is paid in two parts: half as an advance payment on confirmation, half before the site is published. I start work once the advance payment has been made; the site goes live once it has been paid in full.
  • From the Growth package upwards (including a custom site), you can pay the setup in 3 interest-free instalments: on confirmation, at publication and one month after publication. With instalments, the site goes live once the 2nd instalment has been paid.
  • Payment is due within 14 days of the invoice date, unless agreed otherwise.
  • You pay by bank transfer against the proforma invoice or invoice, using a UPN payment order (Slovenian payment slip). Card payment through Stripe is possible once it is available on the site.
  • Statutory default interest applies to late payments.

Benefits

  • Deadline guarantee: Start and Growth: I publish the site within 4 weeks of receiving your material; if I don't, the first month of the subscription is free. Fully Managed and custom websites: we write the deadline into the order (it depends on the photo shoot).
  • Bonus for the first 5 businesses: Instead of a discount: the »Social media posts« AI assistant with no monthly fee for the first 3 months, with the Growth package and custom websites. The assistant's set-up stays at the list price. With Fully Managed you can choose it as your assistant of choice, which is already included. Valid while there are places left at the starting price (the first 5 businesses).
  • Capacity: I take on at most 2 new websites a month.
  • Referral reward: 1 month of the subscription free for every referred business that places an order (accountants as partners too). The reward is not tied to a Google review.
  • Free trial for accounting firms: Up to 20 invoices through invoice capture, with no obligation.
  • Upgrade: When you move to a bigger package, you only pay the difference in the set-up price.

How the work proceeds and revisions

During the build, the site is on a test address that only you can see — you can follow how it takes shape on your phone and computer as it goes. The price includes two rounds of revisions: you collect your comments and send them to me in one go. Small corrections (typos, swapping an image) I make as we go.

Withdrawal from the contract

If you withdraw from the contract after work has started as a business (for the purposes of your trade), the advance payment is not refunded — it covers the work already done and the time reserved for you. If more work has been done than the advance payment covers, it is charged at an hourly rate of €40/hour, up to the agreed price at most. The draft and the photographs produced up to that point are handed over to you after payment.

This does not apply to consumers who withdraw within 14 days: the “Consumers” section applies to them — I refund all payments received, except a proportionate share of the service you expressly requested before the period ended.

Subscription (maintenance and hosting)

The monthly subscription (hosting, updates, backups and the services in the package) starts when the site is published and is paid monthly in advance. There is no annual commitment. You can cancel the subscription at any time, without giving a reason, with one month's notice. On cancellation I hand over the content of the site to you; the site and the domain remain yours.

The domain is always registered in your name and remains yours. As part of the subscription, the provider manages the domain's DNS records (connecting the site, email and Google), so you do not have to worry about technical changes. Before DNS is moved to the provider, all existing records are copied over, so that email keeps working. On cancellation I give you a list of all records and help you move the name servers to a provider of your choice.

AI assistants

You can order an AI assistant on its own, as part of a package or for an existing site. Language model usage is part of the monthly amount in the price list — there is no separate bill for AI. A daily usage limit protects against misuse, so that the cost does not run away.

The AI assistant answers on the basis of information we prepare together, and it is marked as AI for visitors. Despite careful set-up, it may sometimes give an incomplete or wrong answer; its answers are not a binding offer from your business. You use an assistant that prepares drafts (replies to reviews, emails, instructions) by checking and approving the draft yourself before it is published or sent.

The same Working guarantee applies to AI assistants as to the site (section “Handover and defects”); there is no refund of payments.

Where, in doing so, I process personal data of your customers on your behalf (e.g. enquiries through a form or an AI assistant), I do so as your processor, only on your instructions. With clients for whom I process data, I conclude a data processing agreement.

What I need from you

For the work to run smoothly, I need texts, a logo, business details and access to existing accounts (domain, email, social media) where needed. The deadline is extended by as long as I wait for the material.

You are responsible for the content you give me — including having the right to use the images and texts you send.

Changes during the work

Minor corrections during the build are included. A change of scope (a new subpage, a new feature, a new photo shoot) is additional work; before it is carried out, you receive a price and confirm it.

Handover and defects

At launch I show you how to edit the site. Defects reported within 30 days of launch that result from my work I fix free of charge. Throughout maintenance (the subscription) the Working guarantee applies: I fix a defect resulting from my work free of charge within 2 working days of it being reported. The guarantee does not mean a refund. This does not apply to changes caused by the intervention of a third party, or to requests that go beyond the agreed scope.

After payment in full, you receive the right to unlimited use of the site built and the photographs taken for your business — online, in print and on social media, without time limit.

Authorship of the photographs stays with me (moral rights of the author). You may not resell the photographs or make them available to third parties outside your own business.

I reserve the right to cite the site and photographs as a reference and to publish them in my portfolio. If you do not want this, tell me and there will be no reference.

Liability

I do my best to keep the site working, but I cannot guarantee uninterrupted availability, as this depends on the hosting and domain provider. The provider's liability is limited to the amount the client has paid in the last 12 months (set-up and subscription); liability for indirect damage (loss of profit, loss of revenue) is excluded.

The limitation and exclusion do not apply to damage caused intentionally or through gross negligence (Article 242 of the Slovenian Obligations Code) and do not affect the rights consumers have under the Consumer Protection Act (ZVPot-1).

Consumers

If you order a service as a consumer (not for the purposes of your business), you have the right to withdraw from a distance contract within 14 days of its conclusion without giving any reason. A clear statement is enough, for example an email to info@zanmeke.com; you may also use the form below.

On withdrawal I refund all payments received no later than 14 days after receiving your statement, using the same means of payment you used. If you expressly requested that I start work before the period ends, you pay me a proportionate share of the work already done. If the service was fully performed at your express request before the period ended and you acknowledged that you thereby lose the right of withdrawal, withdrawal is not possible.

Gift vouchers

  • A voucher is a value in euros and is valid for 12 months from the day of payment; the date and the code are printed on the voucher. Its value is deducted from the price of any service.
  • A voucher cannot be exchanged for cash; this does not affect the right of withdrawal below.
  • A consumer buyer may withdraw from the purchase of a voucher within 14 days of purchase if the voucher has not been redeemed. I refund the amount paid (for a promotion, the amount actually paid) using the same means of payment, within 14 days at the latest.

Model withdrawal form

Complete and return this form only if you wish to withdraw from the contract.

Complaints and dispute resolution

Send complaints to info@zanmeke.com; I reply within eight days. We resolve disputes amicably; failing that, the court with subject-matter jurisdiction in the Republic of Slovenia is competent. The law of the Republic of Slovenia applies.

The provider does not recognise any alternative dispute resolution provider for consumer disputes as competent.

Changes to the terms

I may change these terms; contracts already concluded are governed by the terms in force when the quote was confirmed.
